Families who have borrowed heavily, students who staked their futures on U.S. study, <\/strong>all asked the same question: Will this crush our dream?<\/p>\n\n\n\n<p><a href=\"https:\/\/economictimes.indiatimes.com\/nri\/work\/trump-to-impose-new-100000-fee-for-h-1b-visas-in-sweeping-overhaul-report\/articleshow\/124004554.cms?from=mdr\" target=\"_blank\" rel=\"noopener\" title=\"\">Read More&#8230;<\/a><\/p>\n\n\n\n<p id=\"ember57\">As your mentor, I want to tell you this<strong> is serious, but not the end of the road.<\/strong> Let\u2019s look at what the proclamation really does, how it may affect you, and why there are reasons to hope for balance in the months ahead.<\/p>\n\n\n\n<p id=\"ember58\"><strong>What the Proclamation Really Says<\/strong><\/p>\n\n\n\n<p id=\"ember59\"><strong>1. It is a Proclamation, not an Executive Order<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Effective <strong>Sept 21, 2025,<\/strong> at 12:01 a.m. ET.<\/li>\n\n\n\n<li>Valid for <strong>12 months only<\/strong>, though it could be extended.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember61\"><strong>2. It is framed as a travel restriction<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It stops individuals from <strong>entering or re-entering the U.S. in H-1B status<\/strong> unless the petition includes the $100,000 payment.<\/li>\n\n\n\n<li>In plain words, the gate slams shut on H-1B entry without that check.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember63\"><strong>3. Students inside the U.S. may not be directly affected<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you are on <strong>F-1 or OPT<\/strong> and your employer files a <strong>Change of Status to H-1B while you remain inside the U.S.<\/strong>, you are not subject to the $100,000 charge.<\/li>\n\n\n\n<li>The proclamation applies to those <strong>outside the U.S. or attempting to enter.<\/strong><\/li>\n<\/ul>\n\n\n\n<p id=\"ember65\"><strong>4. Per petition, not clearly \u201cannual\u201d<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Despite headlines, the text ties the $100k to <strong>H-1B petitions for those abroad.<\/strong><\/li>\n\n\n\n<li>That means it\u2019s likely per <strong>petition filed for entry<\/strong>, not an automatic $100k every year for every H-1B worker.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember67\"><strong>Short-Term Pain: What This Means Now<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>For companies:<\/strong> Expect hiring freezes and reduced sponsorships. Even if COS inside the U.S. is safe, uncertainty makes employers hesitant.<\/li>\n\n\n\n<li><strong>For students abroad or <\/strong>traveling: If you leave and try to return on an H-1B, your employer faces a $100,000 hit. Many will simply refuse.<\/li>\n\n\n\n<li><strong>For students inside the U.S.:<\/strong> If you stay put and file a COS, you may avoid the fee. But be warned: travel is risky. If you exit and re-enter, the proclamation applies.<\/li>\n\n\n\n<li><strong>For families with loans:<\/strong> I know this feels crushing. You planned for H-1B as a repayment bridge. This policy shakes that bridge.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember69\">In the next few months, treat this as a <strong>stormy season<\/strong>: unpredictable, uncomfortable, and financially painful.<\/p>\n\n\n\n<p id=\"ember70\"><strong>Medium-Term: Courts and Congress Step In<\/strong><\/p>\n\n\n\n<p id=\"ember71\">America has checks and balances, and they often kick in after the political theatre.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Courts:<\/strong> Presidents cannot impose massive fees without Congressional approval. This proclamation is vulnerable to challenges under the Administrative Procedure Act and &#8220;separation of powers&#8221;.  Courts have blocked or narrowed similar executive actions before \u2014 the Travel Ban (2017), DAPA (2012), and even USCIS fee hikes (2020).<\/li>\n\n\n\n<li><strong>Congress &amp; Lobbying:<\/strong> Big Tech and universities depend on H-1Bs. In 2022, over <strong>70% of H-1Bs were granted to Indians, mostly in tech.<\/strong> Companies like Google, Amazon, and Microsoft will lobby hard. History shows lobbying can soften or overturn immigration crackdowns.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember73\">So while the proclamation is real today, the legal and political system is already grinding into action.<\/p>\n\n\n\n<p id=\"ember74\"><strong>Long-Term Scenarios (12\u201324 Months)<\/strong><\/p>\n\n\n\n<p id=\"ember75\"><strong>1. Struck Down (Best Case):<\/strong> Courts find the $100k exceeds presidential authority. The proclamation expires or is blocked.<\/p>\n\n\n\n<p id=\"ember76\"><strong>2. Watered Down (Middle Case):<\/strong> Survives in a narrower form \u2014 applying only to new entries from abroad or to very high-salary cases.<\/p>\n\n\n\n<p id=\"ember77\"><strong>3. Full Enforcement (Worst Case):<\/strong> Survives intact. Smaller companies abandon H-1Bs; only mega-caps pay the premium.<\/p>\n\n\n\n<p id=\"ember78\"><strong>What You Should Do<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>If you are inside the U.S. (F-1\/OPT): <\/strong>File a Change of Status, avoid unnecessary travel, and keep building your profile.<\/li>\n\n\n\n<li><strong>If you are planning to go:<\/strong> Be realistic \u2014 the U.S. pathway is uncertain. Keep Canada, Europe, and Australia in your back pocket.<\/li>\n\n\n\n<li><strong>If your family has loans:<\/strong> Don\u2019t despair. OPT is untouched, COS is safe, and courts may give relief. Your career path is still viable, though bumpier.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember80\"><strong>A Mentor\u2019s Note of Hope<\/strong><\/p>\n\n\n\n<p id=\"ember81\">This proclamation feels like a storm, and right now you may see only the rain. But storms pass. America\u2019s <strong>courts, Congress, and companies<\/strong> have powerful reasons to fight this, and history shows us they often succeed.<\/p>\n\n\n\n<p id=\"ember82\">In the <strong>short term, expect pain.<\/strong> But in the <strong>long run, balance usually returns.<\/strong><\/p>\n\n\n\n<p id=\"ember83\">Your dreams are not broken \u2014 they are being tested.
